Definitions

"Account" means the account You open with Us to allow You to play the Game

"Affiliate" means the person, website or business who has referred You to Our Site and will earn commission from Us for the Games You play in accordance with our Affiliate terms and conditions.

Use of this Site and participation in Games is at Your sole option, discretion and risk.

It is Your responsibility to verify that it is legal for You to play any Games on this Site in any jurisdiction where You are located. You agree that if it is not legal for You to do so, You will not participate or use this Site.

Your Conduct

It is possible to make comments on the Site during the Game.

By using the Site, You are agreeing not to use any offensive, aggressive or inappropriate language and/or provide any misleading, untrue or inaccurate information (and/or any information which is designed to facilitate any unauthorised activities) in the messaging areas of the Site.

If any comments are deemed to be offensive, abusive or inappropriate in any way, We, in our sole discretion, are entitled to suspend or close Your Account immediately. Any monies in Games in progress will be lost and any monies remaining on Your Account would be returned to You in accordance with the Account Closing Policy. You are responsible for all comments You make on the Site, including for any subsequent legal action which may arise. We have no liability for comments made by You on the Site.

By opening an Account, You are warranting and undertaking to Us that :

• You are at least 18 years of age;
• Under the laws of the country You reside or are domiciled, You are legally able to open an Account and participate in the Games;
• You will not permit any other third party to directly or indirectly use Your Account in any way;
• You have supplied Us with personal details that are valid, accurate and complete in all respects and that You will advise us immediately in writing should such details change;
• You have read and understood these Terms and Conditions and You agree to be bound by these Terms and Conditions.

We may restrict Your access to Your Account, suspend or terminate Your account or withdraw Your entry for Games in our absolute discretion at any time including if:

• There is a technological failure;
• We suspect that You are engaging in illegal or fraudulent activity;
• We suspect that You have (or may have) breached any part of these Terms and Conditions;
• We suspect You are acting in a manner that is detrimental to Us or which may result in legal liability for You, Us or third parties; or
• We suspect that You may be having difficulties obtaining credit

If We deregister or exclude or suspend Your Account at any time, We shall have the right to:

• Withhold payment to You of any contested funds whether such contested funds are deposits, refunds, bonuses or winnings; and/ or
• Exclude You from the Site and any Games or other products or services that We may offer from time to time;
• Determine what criteria, if any, You shall have to meet in order to establish a new Account.

No interest shall accrue on positive Account balances.

You may close Your Account at any time subject to the Account Closure Policy.

Dormant Accounts

If Your Account has a credit balance and You have not accessed Your Account by logging into the Site for any consecutive period of three years, Your Account will be deemed 'dormant'.

Once Your Account is dormant, We will make all reasonable efforts to locate You as the owner of the Account but if We are unsuccessful after a reasonable period of time, the funds will be removed from Your Account and Your Account will be suspended. Such funds will then be forfeited to a charity of Our choice.

Payment Providers

In order to participate in Games, You will be required to send money to, and may be required to receive money from Us. We may use third-party electronic payment processors and/or financial institutions to process such financial transactions. You agree to authorise Us, in Your name to instruct such processors to handle Account deposits and withdrawals from Your Account and agree that We may give instructions on Your behalf in accordance with Your requests, or as consequence of Your Account activity or status.

You agree to be bound by the terms and conditions of use of each applicable electronic payment processor if applicable.

General Terms

Amendments

We reserve the right to amend these Terms and Conditions, including policies, rules and procedures at any time. Reasonable notice of any such changes and when they will be effective from will be communicated to registrants. It is Your responsibility to keep up to date with and understand the changes made as they are binding on You. Use of the Site by You following implementation of the changes constitutes Your acceptance of the Terms and Conditions as amended.

Copyright and Trademarks

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights, current or in the future, in all material or content used or supplied as part of the Site shall remain at all times owned by and vested in Us or one of Our associated companies or our licensors and is protected by copyright and/or other intellectual property rights. Matters beyond our reasonable control

We are not liable for any loss or damage that You may suffer because of any matter beyond Our reasonable control including, without limitation, any one or more of the following: acts or restraints of governments or public authorities; war, riot or civil commotion; strikes, lock outs or other industrial action, whether of Our employees or others. We are not liable for the failure of any equipment or software howsoever caused, wherever located or administered, or whether under our direct control or not, that may prevent the operation of the Games, or prevent You from being able to contact Us.

We reserve the right to cancel or suspend Our services without incurring any liability.

Indemnity and Limitation of liability

You agree to indemnify and hold Us and our associated companies, suppliers, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising from Your breach of these Terms and Conditions, access, use or inability to access or use the Site and/or participate in a Game, breach of any third party rights, including without limitation, any copyright, proprietary, or privacy right; or breach of any law or regulation.

In no event will We, or any of our associates or suppliers, accept any liability however arising for any losses You may incur as a result of using this Site including any indirect, special or consequential damages or loss of profits (direct or indirect). Nothing in these Terms and Condition excludes our liability with respect to death and personal injury resulting from our negligence, or that of our employees, agents or subcontractors.

Assignment

We reserve the right to transfer, assign, sub-license or pledge, in whole or in part, any of the rights and obligations granted to or imposed upon us by these Terms and Conditions. You may not transfer, assign, sub-license or pledge any of the rights and obligations granted to or imposed upon You by these Terms and Conditions without our written consent.

Severability

In the event that any provision of these Terms and Conditions is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.

Dispute resolution

We will attempt to resolve any disputes or complaints that You may have in regard to Our products or service. If You wish to raise any issue with Us, then please contact Us here. We will attempt to respond to all e-mails within 5 business days of receipt.

Gaming Disputes

If You have a gaming dispute in relation to one of our Games, which You believe that We have not satisfactorily resolved, You can approach IBAS (The Independent Betting Adjudication Service). IBAS is a third party organisation offering independent adjudication in relation to betting and gaming disputes.

Third Parties

Unless otherwise expressively stated, nothing in these Terms and Conditions shall create or confer any rights on any persons not party to these Terms and Conditions.

No waiver

No failure or delay by a party to exercise any of its rights under these Terms and Conditions shall operate as a waiver thereof and no single or partial exercise of any such right shall prevent any other or further exercise of that or any other right.

Entire Agreement

Unless the context otherwise indicates, these Terms and Conditions set out the entire agreement between Us and You and supersede all prior oral or written agreements, arrangements or understandings between Us and You in relation to the matters described within these Terms and Conditions.

Applicable Law & Jurisdiction

These Terms and Conditions shall be governed by the laws of England & Wales and shall be subject to the exclusive jurisdiction of the court of England & Wales to which the parties irrevocably submit.
